Terms and Conditions of Sale

The Bâton Rouge team invites you to review these Terms and Conditions of Sale, which you agree to accept if you wish to place an order on our website:

The offer and sale of products on our website (batonrougeparis.fr) are governed by these Terms and Conditions of Sale. We recommend that you read them carefully.

Products purchased on www.batonrougeparis.fr are sold directly by SAS Percheron Cosmetics.

Orders placed on the website are reserved for private individuals and businesses acting as “end customers,” other than for resale purposes. The resale or distribution of products purchased on batonrougeparis.fr is strictly prohibited.

Each time you place an order on batonrougeparis.fr, you will be asked to confirm your acceptance of the Terms and Conditions of Sale in force on the date of your order.

In light of the commercial policy described above, Bâton Rouge Paris reserves the right not to process orders from persons who are not “end customers” or orders that do not comply with these Terms and Conditions.

These Terms and Conditions may be amended, particularly in consideration of regulatory changes. The new Terms and Conditions shall apply from the date of their publication on batonrougeparis.fr.

Article 1 – Availability

Our product offers are valid subject to availability.

At the time of ordering, please verify item by item that the quantity, size, and price are correctly reflected in your order summary.

When a product is no longer available, it will be displayed as “OUT OF STOCK.” In such cases, you may contact us to be informed of potential restocking online or in-store.

Article 2 – Gift Vouchers and Gift Cards

Gift vouchers issued by the Seller in exchange for a return, as well as gift cards purchased by the Customer, are valid for one (1) year on all products available on www.batonrougeparis.fr.

After this period, they shall be considered expired and will neither be refundable nor exchangeable.

Gift vouchers cannot be combined with one another or with promotional codes.

Gift vouchers and gift cards cannot be redeemed for cash under any circumstances, including in cases of force majeure (loss, damage, expiration, etc.).

Article 3 – Promotional Codes

Promotional codes apply only to non-discounted base prices.

Promotional codes cannot be combined with one another or with gift vouchers.

Unless otherwise stated by the Seller, promotional codes may be used only once per individual.

Promotional codes are non-refundable in the event of an exchange.

Article 4 – Orders

When placing your first order, you must create an online account using your personal details and keep them updated.

The contract is deemed concluded when Bâton Rouge receives the electronic order form, after verifying the accuracy of the order details.

Before completing your purchase, you are required to carefully read these Terms and Conditions of Sale.

By electronically submitting the order form, you unconditionally accept these Terms and agree to comply with them.

Article 5 – Prices and Payment

Product prices are indicated in euros (€), inclusive of all taxes, excluding shipping costs.

Bâton Rouge reserves the right to modify prices at any time; however, products will be invoiced based on the rates in effect at the time the order is recorded, subject to availability.

When you click “Order,” you may pay using:

  • Credit card: Visa, American Express, Mastercard

  • PayPal

Your order will only be shipped after verification of your payment method.

Article 6 – Order Validation

The data recorded by batonrougeparis.fr at the time of order confirmation constitutes proof of all transactions between batonrougeparis.fr and its customers.

The data recorded by the payment system constitutes proof of financial transactions.

Article 7 – Delivery

Products purchased on batonrougeparis.fr are deliverable under the conditions described in the “Delivery” section at the bottom of the website.

For security reasons, Bâton Rouge will not process orders where a P.O. Box or Cedex address is provided.

You agree to provide your full delivery address when placing your order, including any necessary additional information (building, floor, stairway, access code).

Orders are shipped within 2 to 4 business days (excluding weekends and public holidays) within Metropolitan France. We also deliver internationally.

Delivery Tracking

We personally monitor each shipment. You may also track your order using the tracking number provided once your parcel leaves our premises.

Delivery Issues

Any delivery defect or delay exceeding eight (8) business days must be reported to our Customer Service as soon as possible (contact@batonrougeparis.fr).

Any claim submitted more than fifteen (15) calendar days after the order validation date will not be accepted.

You must check the conformity of the goods upon delivery. In case of anomalies (opened package, damaged product, etc.), you must indicate this on the carrier’s delivery slip and contact Customer Service by email.

In the event of non-conformity or dissatisfaction, products may be returned, exchanged, or refunded in accordance with the conditions set out in Article “Returns / Exchanges.”

Article 8 – Returns / Exchanges

Bâton Rouge is committed to providing high-quality products. However, if you are not satisfied, Bâton Rouge undertakes to exchange or refund the product.

Return shipping costs are borne by the Customer. In the case of an exchange, the shipping costs for the replacement product will be borne by Bâton Rouge.

In accordance with Articles L.121-20 et seq. of the French Consumer Code, you have fourteen (14) days from receipt to return products.

Refunds will be processed using the original payment method within a maximum of fourteen (14) days after receipt of the returned item.

Damaged or incomplete items will not be accepted and will be returned to you at your expense.

Used products will neither be exchanged nor refunded.

Article 8.1 – Right of Withdrawal

The Customer has fourteen (14) clear days from receipt of the order to notify Bâton Rouge of their decision to withdraw.

To exercise this right, the Customer must inform Bâton Rouge by email within this period.

Returned products must be sent within fourteen (14) days following notification to:

For hygiene and health protection reasons, and in accordance with Article L221-28 of the French Consumer Code, products that have been opened after delivery cannot be returned under the right of withdrawal.

If the conditions are met, Bâton Rouge will refund all amounts paid, including initial delivery costs (excluding return shipping costs), within fourteen (14) days from notification of withdrawal. Bâton Rouge reserves the right to defer the refund until the products are recovered.

Article 9 – Mediation

The Customer is informed of the possibility of resorting to consumer mediation in the event of disputes relating to the sale of Bâton Rouge products.

Disputes may not be reviewed by the mediator if the claim is manifestly unfounded or abusive, has already been examined or is under examination by another mediator or court, if submitted more than one year after a written complaint to Bâton Rouge, or if the Customer has not attempted to resolve the dispute directly with Bâton Rouge in writing beforehand.

Article 10 – Legal Guarantee

Products sold on the Site comply with French regulations in force.

Products supplied by Bâton Rouge benefit, without additional payment and independently of the right of withdrawal, from:

  • The legal guarantee of conformity (Articles L.217-4 et seq. of the French Consumer Code)

  • The legal warranty against hidden defects (Articles 1641 et seq. of the French Civil Code)

The Customer may choose between repair or replacement, subject to cost conditions provided by law.

Refunds for non-compliant or defective products will be made within thirty (30) days following acknowledgment of the defect.

Bâton Rouge’s liability is limited to the replacement or reimbursement of non-compliant or defective products.

Article 11 – Intellectual Property

All texts, comments, works, illustrations, and images reproduced on batonrougeparis.fr are protected by copyright and intellectual property rights worldwide.

Only private use is permitted. Any other use constitutes infringement unless prior authorization is granted.

Any total or partial reproduction of the batonrougeparis.fr catalogue is strictly prohibited.

Article 12 – Liability

Products comply with French legislation in force. It is your responsibility to verify with local authorities the import or use conditions applicable in your country.

12.1 – Limitation of Liability

The Seller shall not be liable for indirect or special damages arising from negligence, misuse, or improper handling of products.

The Seller shall not be liable for inconveniences inherent to internet use, including connection disruptions or computer viruses.

In any event, the Seller’s liability is limited to the amount of the Customer’s order.

Neither party shall be liable for failure to perform obligations due to force majeure as defined under Article 1218 of the French Civil Code.

Article 13 – Governing Law and Jurisdiction

This contract is concluded in the French language and governed by French law.

In the event of a legal dispute, only French courts shall have jurisdiction.

Article 14 – Personal Data

batonrougeparis.fr undertakes not to disclose to third parties any information you provide.

Data is used internally for order processing, communication, newsletters, and site personalization.

In accordance with the French Data Protection Act of January 6, 1978 and applicable regulations, you have the right to access, rectify, and object to your personal data.
